Abstract

Next year, Mediation, an alternative dispute resolution method, will be introduced in our legal system to solve a lot of disputes, avoiding the worry, time and cost associated with court-based litigation and assisting citizens and firms in a real way to secure their legal rights. Its techniques will allow the parties to resume dialogue and come to a solution to their dispute through negotiation instead of getting locked into a logic of conflict and confrontation with a winner and a loser at the end. Mediation will be used in complex commercial disputes where the parties, whilst wishing to resolve a conflict, also wish to retain as far as possible a continuing commercial relationship to assure firms to be successful in competitive market, improving their performance.
